1. Acceptance

By accessing or using services provided by Mark-42 Studio ("we", "us") at mark-42.co and its subdomains, you agree to these Terms. If you do not agree, do not use our services.

2. Services

We provide web applications and digital products. Specific features and availability may vary. We reserve the right to modify, suspend, or discontinue any service with reasonable notice.

3. Accounts

You must provide accurate information when creating an account.
You are responsible for maintaining the security of your credentials.
One person or entity per account. Shared or bot accounts are not permitted without prior approval.
We may suspend accounts that violate these terms.

4. Acceptable Use

You agree not to:

Use our services for illegal purposes
Attempt to gain unauthorized access to our systems
Interfere with or disrupt service operations
Scrape, crawl, or harvest data without permission
Upload malicious code or content

5. Intellectual Property

Content you create using our services remains yours. We do not claim ownership of your data. Our service code, design, and branding are proprietary and protected by applicable laws.

6. Data and Privacy

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to data practices described therein.

7. Availability and SLA

We strive for high availability but do not guarantee uninterrupted service. Current service status is available at status.mark-42.co. Planned maintenance will be communicated in advance when possible.

8. Limitation of Liability

To the maximum extent permitted by law, Mark-42 Studio shall not be liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

You may delete your account at any time. We may terminate your access for violation of these terms with notice. Upon termination, your data will be deleted per our retention policy (see Privacy Policy).

10. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. Disputes shall be resolved in the courts of Nuremberg, Germany.

11. Changes

We may update these terms. Material changes will be notified 30 days in advance. Continued use constitutes acceptance.
